Title VII – Discrimination and Retaliation Claims
Title VII of the Civil Rights Act of 1964 is the most comprehensive federal response to the problems of employment discrimination. In general, Title VII prohibits employers from discriminating against its employees (or job applicants) on the basis of:
- Race
- Color
- Gender
- Religion
- National Origin
- Retaliation
Similar laws prohibit employers from discriminating on the basis of:
- Pregnancy
- Age (over 40 years old)
- Disability (physical or mental)
Title VII enables the Equal Employment Opportunity Commission (EEOC) and the federal courts to review the hiring, promotion, and termination practices of employers to ensure that they are not engaging in discriminatory practices.
Employers Covered
Title VII applies to both private and public employers with 15 or more employees. The Americans with Disabilities Act (ADA) applies to both private and public employers with 15 or more employees. The Age Discrimination in Employment Act (ADEA) applies to employers with 20 or more employees.
Damages Recoverable
Title VII authorizes the recovery of the following elements of damages: back pay, front pay, compensatory damages (i.e. future pecuniary damages, mental anguish, emotional pain, suffering, inconvenience, loss of enjoyment of life, etc…), and, in some cases, punitive damages and attorney’s fees. Not all persons will be entitled to the recovery of all of these types of damages. Rather, each claim is different and requires a thorough an independent analysis.
Time Limits and Administrative Filing Requirements
