Minimum Wage Requirements
Federal law sets the minimum wage in the U.S. at $7.25 per hour. However, there are some exceptions to the minimum wage requirement. Employees under 20 years old can be paid a "training wage" $4.25 per hour for the first 90 days of employment. Employers cannot replace an employee earning the minimum wage in order to hire an employee at the training wage rate.

Overtime Pay Requirements
Employees who are not exempt from overtime pay requirements must be paid one and a half times their hourly pay rate for each hour over 40 they work each week. Payment must be in cash, not time off or other types compensation.

Employees who are exempt from minimum wage and overtime pay requirements include:

Employees who receive a salary rather than an hourly wage are typically considered exempt from overtime pay requirements. However, since August 23, 2004, all employees earning less than $455 per week or $23,660 per year are automatically entitled to receive overtime pay even if they are salaried employees.

The Fair Labor Standards Act (FLSA) is a federal law protecting workers' rights to be paid fairly. Complicated and difficult to understand, the law is often violated, knowingly and unknowingly, by employers.
